Terms of Service

Please read these Terms of Service ("Terms") carefully before using BudgetKit ("the App"). The App is operated by Gavyn Stanley ("I", "me", or "my").

1. Acceptance of Terms

By downloading, installing, or using the App in any way, you confirm that you have read, understood, and agree to be bound by these Terms and the Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Gavyn Stanley. Your continued use of the App after any update to these Terms constitutes acceptance of the revised Terms.

2. License

Subject to your compliance with these Terms, I grant you a personal, non-exclusive, non-transferable, revocable, limited license to download and use the App on devices you own or control, solely for your personal, non-commercial purposes. This license does not include the right to sublicense, modify, or create derivative works from the App.

3. Account & Authentication

BudgetKit requires an account to use. You may create an account using Apple, Google, or a username and password. Once your account is created, you may register a passkey (WebAuthn) as an additional sign-in method.

You must be at least 13 years of age to create an account and use the App. By creating an account, you represent and warrant that you meet this age requirement.

You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• Restricting access to your devices to prevent unauthorized use of your account
• All activity that occurs under your account, whether or not authorized by you

You agree to notify me immediately at support@budget-kit.com if you suspect any unauthorized access to or use of your account.

4. User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
• Resell, sublicense, rent, lease, or otherwise transfer rights to the App
• Use the App for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to any systems, servers, or networks connected to the App
• Introduce malware, viruses, or any other malicious code into the App or its infrastructure
• Use automated tools to scrape, crawl, or extract data from the App
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the integrity or performance of the App or its related services

5. Intellectual Property Rights

The App, including its name, logo, trademarks, trade dress, source code, design, graphics, text, and all other content and materials, is owned by Gavyn Stanley and is protected by applicable intellectual property laws. All rights not expressly granted in these Terms are reserved.

The "BudgetKit" name and logo are proprietary to Gavyn Stanley. You may not use them without my prior written consent, except as expressly permitted by these Terms or applicable law.

Your content: You retain ownership of the financial data you enter into the App (transactions, accounts, budgets, and related information). By using the App, you grant me a limited, non-exclusive license to store, process, and transmit your data solely as necessary to provide the service to you. I do not claim any ownership over your financial data.

6. Privacy & Your Data

Your use of the App is also governed by the Privacy Policy, which explains how I collect, use, and protect your information. By using the App, you consent to the data practices described in the Privacy Policy.

Your financial data is stored on my servers to enable syncing across your devices. I take reasonable measures to protect your data, but you acknowledge that no method of electronic transmission or storage is completely secure.

7. Pricing & In-App Purchases

BudgetKit is free to download. Certain features or functionality may require an in-app purchase or subscription, available through the Apple App Store. All purchases and subscriptions are processed and managed by Apple. I do not collect or store payment information.

Subscription pricing, billing intervals, and any applicable free trial periods are disclosed at the point of purchase within the App. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your Apple ID account settings.

Your purchase is subject to Apple's Media Services Terms and Conditions. Because all billing is handled by Apple, I do not process refunds directly. Refund requests must be submitted to Apple through your Apple ID purchase history or at reportaproblem.apple.com. Apple's refund policies govern all such requests.

8. Third-Party Services

The App integrates optionally with SimpleFIN to import bank transactions, and optionally with Apple or Google for authentication. Your use of these services is subject to their own terms of service and privacy policies. I am not responsible for the availability, accuracy, security, or conduct of third-party services.

9. Termination

I reserve the right to suspend or permanently terminate your account and access to the App at any time, with or without notice, if I reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or for any other reason at my sole discretion.

You may terminate your account at any time by using the Delete Account option in Settings within the App, or by contacting me at support@budget-kit.com. Deletion requests are subject to a minimum 24-hour grace period before your account and data are permanently removed. Upon termination, your license to use the App ceases immediately. Account data will be deleted in accordance with the Privacy Policy.

Sections 5 (Intellectual Property), 10 (No Warranties), 11 (Limitation of Liability), and 12 (Governing Law) survive termination of these Terms.

10. No Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

I do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Financial data imported from third-party services may not always be accurate or up to date — always verify important figures with your bank or financial institution.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Gavyn Stanley shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of revenue, or financial loss arising out of or in connection with your use of or inability to use the App, even if advised of the possibility of such damages.

In no event shall my total liability to you for all claims arising out of or relating to these Terms or your use of the App exceed the amount you paid me in the twelve (12) months preceding the claim, or $10 USD, whichever is greater.

12. Changes to the App

I reserve the right to modify, suspend, or discontinue any part of the App at any time without notice. I am not liable to you or any third party for any such modification, suspension, or discontinuation.

13. Changes to These Terms

I may update these Terms from time to time. I will post the updated Terms at this URL with a revised "last updated" date. Where changes are material, I will make reasonable efforts to notify you (such as via an in-app notice). Continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

In the event of any dispute arising out of or relating to these Terms or your use of the App, you and I agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be subject to the exclusive jurisdiction of the state and federal courts located in Georgia, and you consent to personal jurisdiction in those courts.
